4.2. In accessing the website, you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of Skylight Editorial. This excludes the downloading, copying and/or printing of pages of the website for personal, non-commercial use only.

4.3. When you submit your material to Skylight Editorial, you retain copyright of such material. Skylight Editorial does not require any credit or acknowledgment for work that has been completed (other than payment for the service that we provide). Skylight Editorial will not use or disclose material submitted to us for any reason other than providing our services.

4.4. By submitting your document do so under the agreement that you own or otherwise control all of the rights to the material that you submit. You also agree that the material is accurate; that use of the material you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Skylight Editorial and/or its affiliates for all claims resulting from material you supply.

4.5. Skylight Editorial has the right but not the obligation to monitor and refuse any activity or content. Skylight Editorial takes no responsibility and assumes no liability for any material submitted by you or any third party.

4.6. You may not use any Skylight Editorial logo or other proprietary graphic or trademark without express written consent from Skylight Editorial.

4.7. Skylight Editorial’s work on any document does not imply any endorsement of its content or of the author. Skylight Editorial expressly prohibits the association of Skylight Editorial and any Skylight Editorial trademark, editor, affiliate, or personnel with any published work, including by way of acknowledgment, without prior written consent. Comments provided to the author by Skylight Editorial and its personnel are provided for personal use only.

5. Service Usage

5.1. Edited documents are transmitted via email. Clients are responsible for checking their emails for correspondence concerning their order.

5.2. If the client decides to cancel an order once the editing process has begun, there may be a service charge for the completed portion of the document.

5.3. Skylight Editorial is not legally obligated to refund the price of any service performed. If a client is dissatisfied with the service(s) provided, contact must be made with Skylight Editorial. Every effort will be made towards an agreeable resolution. Once services have been performed and delivered, the client has five days in which to express dissatisfaction or request revisions. If we have not received notification of dissatisfaction or request for revision during this time, we will consider the project/services completed and fully acceptable to the customer.

5.5. It is the client’s responsibility to ensure the accuracy of the edited document. The client is also responsible for accepting or rejecting changes an editor makes to his or her document, and/or following the editor’s suggestion(s). The services of Skylight Editorial do not include fact checking.

5.6. It is the customers’ responsibility to ensure that the time frame they choose ensures delivery within their deadline(s).

5.7. A maximum of two hours is added to all order times for documents to be queued and for preliminary document checks.

5.8. It is the customers’ responsibility to ensure that the service they choose is commensurate with the needs of their document. Orders may be cancelled if the incorrect service is chosen.

5.9. Though Skylight Editorial aims for 100% accuracy, because of human error, this cannot be guaranteed.

6.  Disclaimers and Limitation of Liability

6.1. The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

6.2. To the extent permitted by law, Skylight Editorial will not be liable for any indirect or consequential loss or damage (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the website.

6.3. Skylight Editorial makes no warranty that the functionality of the website will be uninterrupted or error free, that defects will be corrected or that the website or the server that makes it available are free of viruses or anything else that may be harmful or destructive.

6.4. Nothing in these terms and conditions shall be construed to exclude or limit the liability of Skylight Editorial for death or personal injury because of the negligence of Skylight Editorial or that of its employees or agents.

6.5. Skylight Editorial and its contractors attempt to be as accurate as possible. However, Skylight Editorial does not warrant that product or service descriptions, other content of this site, or its services performed for its customers are accurate, complete, reliable, current, or error free. This site and Skylight Editorial’s services are provided by Skylight Editorial on an “as is” and “as available” basis and at your sole risk. To the fullest extent permissible pursuant to applicable law, Skylight Editorial disclaims all warranties and conditions, expressed or implied, in respect of its services and any information, content, or materials on this site, including any implied warranties or conditions of fitness for a particular purpose, merchantability, and non-infringement.

6.6. If you are dissatisfied with any material from Skylight Editorial, or with any of Skylight Editorial’s terms and conditions, your sole and exclusive remedy is to discontinue using Skylight Editorial’s services.

7.  Indemnity

You agree to indemnify and hold Skylight Editorial and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Skylight Editorial arising out of any breach by you of these terms and conditions or other liabilities arising out of your use of this website.

8.  Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

9. Loss

If there are any costs incurred by any errors remaining in your work, whether grammatical or factual, the final responsibility for errors remains with you. Skylight Editorial cannot be held responsible for any losses incurred.
